Right of withdrawal

Grounds for exclusion of the right of withdrawal

According to article 59, paragraph 1, letters d) and e) of Italian Legislative Decree no. 206 of 6 September 2005 (Consumption Code) and subsequent amendments (Italian Legislative Decree no. 21/2014), the right of withdrawal is excluded in relation to:

a) goods purchased by a non-consumer user and/or one requesting an invoice

b) goods that are likely to deteriorate or expire rapidly 

c) sealed goods which are not suitable to be returned for hygienic reasons or reasons related to the protection of health, if such goods were unsealed after delivery.

With reference to the cases where the right of withdrawal is not applicable, the User shall be considered especially informed and accepts the fact that the products that are "likely to deteriorate or expire" shall include all food products prepared by Vdlwine, as the characteristics and quality of these types of Products are subject to alteration, also as a consequence of inappropriate storage. Therefore, for reasons of hygiene and User protection, the right of withdrawal applies only to Products purchased on the Website that can be returned to Vdlwine with their seal intact and that can be placed on the market without any health hazards considering they are products with long-term preservation properties (example: oil, wine, vinegar).

Exercising the right of withdrawal

The User may exercise the right of withdrawal, pursuant to article 52 et seq. of Italian Legislative Decree 206/2005, for specific Products other than those produced by Vdlwine, provided that these have not been opened or have had their seals altered after delivery.

In cases where the right of withdrawal is permitted, the User is entitled to withdraw from the Purchase Order for any reason without the need for explanation and without any penalty.

In order to exercise the right of withdrawal, the User must send Vdlwine, within 14 days from the date of the Products’ delivery, a written communication via email to the email address info@vdlwine.com, with the subject "Exercise of the right of withdrawal", also:

a) attaching the form which can be downloaded here or

b) expressly declaring their intention to withdraw and providing the following additional information:

i. purchase order number and date

ii. purchase order delivery date

iii. name and address of the Consumer

iv. the indication of the Consumer’s email address and telephone number

v. code of item(s) for which the right to withdraw is to be exercised.

Upon receiving the communication regarding exercise of the right of withdrawal, Vdlwine will proceed with the appropriate return process.

The User must return to the Company, or a third party authorised by the same, without delay and in any case not later than 14 (fourteen) days after the date of notice of their withdrawal, all the Products purchased under the contract the User has withdrawn from, bearing the direct cost of returning the Products. If the Products are returned directly to the Company, they must be sent to the following address: Vdlwine - Via Alba Cortemilia 69- 12051 Alba (CN) - Italy. The Products must be returned intact and, in any case, in the same state as they were received by the User. Refunds will be given by the Company through the same means of payment selection and used by the Consumer in relation to the order for which they exercised the right of withdrawal.

 

Products that cannot be returned

It will not be possible to return products in the cases referred to in Article 59 of the Consumption Code, for example specially customised, cut or individualised products. Sealed products that cannot be returned due to health or hygienic reasons are those for which the seals have been removed after delivery.
